Forum Rules

  1. DO NOT SEND SUPPORT REQUESTS VIA PM, unless expressly invited to do so. Using PM to actively solicit work is not allowed. Post, in accord with the rules in the correct forum. Abuse of the PM system in this way can lead to your membership being removed.
  2. Only one account per person is permitted.
  3. When registering, a valid email address has to be used. Disposable email addresses are not permitted. If found, we will remove the account in question.
  4. Keep all posts on-topic.
  5. All posts must be in English, unless posted in a specific international forum. If posting in a international forum, please use the language of that forum, and not English.
  6. Do not astroturf or pretend to be/represent somebody else. Your account will be deleted if found to be in breach of this rule.
  7. Do not discuss illegal activities. Our server is hosted in the USA and so is subject to US law. Please do not expose us to any unnecessary legal liability.
  8. Check that your question has not been answered anywhere else on the site. Use the search feature.
  9. Post your comment/question to the most appropriate place. Any posts deemed to be in the wrong forum will be moved. Do not cross-post the same question to multiple places.
  10. Make sure you have read the parent article/post completely before posting a reply
  11. Use your own words. If you wish to use the words of somebody else, quote them, citing the source. Plagiarism is unethical and is illegal in many countries.
  12. Choose an appropriate subject line. Try to summarise the problem briefly in the subject, and elaborate in the message itself. Repeat the subject in the body if it will make things clearer. Do not use all caps and do not add false information just to get attention (e.g. ;read this or you will be arrested;). An example of a bad subject would be "HELP ME". A good subject might be, "Foo crashes when I do bar". Do not use a URL as a thread title.
  13. Include as much information as you can when seeking help. This may include logs and command line output. Nobody will be able to help you if you don't give sufficient detail.

  15. No useless posts. This includes: Thread bumping, useless one liners, Flamewars, Trolling and Spamming. What is spamming? Read this.
  16. Thank those who help you. Acknowledgment of a helpful suggestion not only placates those who helped you, it may also help others with a similar problem. All those who have been helped on this forum are invited to help other users by responding to their questions when they know the answer and /or to consider donating to the project.
  17. Do not link to any site that contains adult content, sexually oriented material or might otherwise be considered offensive. Any post containing an inappropriate link will be deleted and the poster will receive a warning.
  18. Do not propose/link to any site that contains warez/copyrighted software/materials that can be downloaded illegally.
  19. No affiliate links to be posted, anywhere on our forum.

At all times:
  1. Keep all commentary civil, and be courteous at all times. Constructive criticism is welcome, but insults directed towards other users or the site admins will not be tolerated. Coarse/insulting language will not be tolerated.
  2. No commercial advertising is permitted.
  3. When recommending an extension or other product to help a user solve their issue, you must disclose any affiliations you may have with the company or group that authors that particular product. This includes, but is not limited to: any paid or non-paid relationships past or present, receiving any promotional products or services, or any other similar information.
  4. Any posts deemed to be self promotion, advertising, or spam can and will be removed. NO SPAM - NO ADVERTISING eg. Posting and making excessive, inappropriate and unnecessary references to your products and websites is self promotion.
  5. This is not the place to settle a commercial disagreement for custom development or to be a 'wall of shame'. Any posts deemed to be of this nature will be removed. Settle your disputes in private please.
  6. If you feel a post violates any of these rules, or you need to bring it to the attention of a moderator (move threads/close/split), please use the ‘report this post’ link to notify the moderators.
  7. These forums are centered on speech pathology. They are not a place to promote ideological, religious, or political matters. All such discussions will be deleted/closed.

Terms and Conditions

 

The Speech Team, Inc. operates speechteam.com, SpeechSpace!, SpeechForum, which are social networking and online forum components that allows Members to create unique personal profiles online in order to find and communicate with old and new friends and colleagues. The services offered by SpeechForum include any SpeechForum-branded URL (the " The Speech Team, Inc. Website"), SpeechForum messaging services (including, without limitation, instant messaging, private messaging, and email services), SpeechForum music and video services, SpeechForum developer services, SpeechForum mobile services, and any other features, content, or applications offered from time to time by SpeechForum in connection with The Speech Team, Inc.’s business (collectively, the "The Speech Team, Inc. Services"). The Speech Team, Inc. Services are hosted in the United States.

 

This Terms of Use Agreement, as may be modified from time to time, ("Agreement") constitutes legally binding terms and applies to your use of the The Speech Team, Inc. Services. By accessing and/or using The Speech Team, Inc. Services, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse The Speech Team, Inc. Services, including, without limitation, through a mobile or other wireless device, or otherwise use The Speech Team, Inc. Services without being registered) or you are a "Member" (which means that you have registered with The Speech Team, Inc.). The term "User" refers to a Visitor or a Member. You are authorized to use The Speech Team, Inc. Services (regardless of whether your access or use is intended) only if you agree to abide by all applicable laws, rules and regulations (“Applicable Law”) and the terms of this Agreement. In addition, in consideration for becoming a Member and/or making use of the SpeechForum Services, you must indicate your acceptance of this Agreement during the registration process.

 

The Speech Team, Inc. reserves the right to modify this Agreement at any time and from time to time, and each such modification shall be effective upon posting on The Speech Team, Inc. Services. All material modifications will apply prospectively only. Your continued use of The Speech Team, Inc. Services following any such modification constitutes your agreement to be bound by and your acceptance of the Agreement as so modified. It is therefore important that you review this Agreement regularly. If you do not agree to be bound by this Agreement and to abide by all Applicable Law, you must discontinue use of The Speech Team, Inc. Services immediately. You may receive a copy of this Agreement by contacting us.

 

  1. 1. Eligibility

Use of The Speech Team, Inc. Services and registration to be a Member for The Speech Team, Inc.Services (“Membership”) is void where prohibited. By using The Speech Team, Inc. Services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older; and (d) your use of The Speech Team, Inc. Services does not violate any Applicable Law. Your profile may be deleted and your Membership may be terminated without warning, if we believe that you are under 13 years of age, if we believe that you are under 18 years of age and you represent yourself as 18 or older, or if we believe you are over 18 and represent yourself as under 18.

 

  1. 2. Term

This Agreement, and any posted revision to this Agreement, shall remain in full force and effect while you use the The Speech Team, Inc. Services or are a Member. You may terminate your Membership at any time, for any reason, by following contacting us. SpeechForum may terminate your Membership at any time, for any or no reason, with or without prior notice or explanation, and without liability. Furthermore, SpeechForum reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including, without limitation, private messages, emails and instant messages (collectively, “messages”)) by you, or to deny, restrict, suspend, or terminate your access to all or any part of The Speech Team, Inc. Services at any time, for any or no reason, with or without prior notice or explanation, and without liability. In addition, SpeechForum reserves the right, in its sole discretion, to reassign or rename your profile URL. SpeechForum expressly reserves the right to remove your profile and/or deny, restrict, suspend, or terminate your access to all or any part of The Speech Team, Inc. Services if SpeechForum determines, in its sole discretion, that you have violated this Agreement or pose a threat to SpeechForum, its employees, business partners, Users and/or the public. Even after Membership is terminated, this Agreement will remain in effect, including, without limitation, Sections 5-18.

 

  1. 3. Fees

You acknowledge that SpeechForum reserves the right to charge for any portion of The Speech Team, Inc. Services and to change its fees (if any) from time to time in its discretion. If SpeechForum terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of fees or payments (if any).

 

  1. 4. Password

When you sign up to become a Member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, email address or password of another Member at any time or to disclose your password to any third party. You agree to notify SpeechForum immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

 

  1. 5. Use by Members

The Speech Team, Inc. Services are for the personal use of Members and may only be used for direct commercial purposes if they are specifically endorsed or authorized by SpeechForum. SpeechForum reserves the right to remove commercial content in its sole discretion. Illegal and/or unauthorized use of The Speech Team, Inc. Services, including, without limitation, collecting usernames, user id numbers, and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to The Speech Team, Inc. Services, or employing third party promotional sites or software to promote profiles for money, is prohibited. Commercial advertisements, affiliate links, and other forms of unauthorized data collection or solicitation may be removed from Member profiles without notice or explanation and may result in termination of Membership privileges. SpeechForum reserves the right to take appropriate legal action, including, without limitation, referral to law enforcement, for any illegal or unauthorized use of The Speech Team, Inc. Services.

 

  1. 6. Proprietary Rights in Content on SpeechForum
    1. SpeechForum does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, "Content") that you transmit, submit, display or publish (“post”) on, through or in connection with The Speech Team, Inc. Services. After posting your Content on, through or in connection with The Speech Team, Inc. Services, you continue to retain any such rights that you may have in your Content, subject to the limited license herein. By posting any Content on, through or in connection with The Speech Team, Inc. Services, you hereby grant to SpeechForum a limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce, and distribute such Content solely on, through or in connection with The Speech Team, Inc. Services, including, without limitation, through The Speech Team, Inc. Services to applications, widgets, websites or mobile, desktop or other services which are linked with your SpeechForum account (collectively, “Linked Services”), including, without limitation, distributing part or all of The Speech Team, Inc. Services and any Content included therein, in any media formats and through any media channels, except that Content marked “private” will not be distributed by SpeechForum outside The Speech Team, Inc. Services and Linked Services. This limited license does not grant SpeechForum the right to sell or otherwise distribute your Content outside of The Speech Team, Inc. Services or Linked Services. After you remove your Content from The Speech Team, Inc. Services we will cease distribution as soon as practicable, and at such time when distribution ceases, the license will terminate. If after we have distributed your Content outside of The Speech Team, Inc. Services, you change the Content’s privacy setting to “private,” we will cease distribution of such “private” Content outside of The Speech Team, Inc. Services as soon as practicable after you make the change. Notwithstanding the foregoing, you understand and agree that once Content is distributed to a Linked Service or incorporated into other aspects of The Speech Team, Inc. Services, SpeechForum is under no obligation to delete or ask other Users or a Linked Service to delete that Content, and therefore it may continue to appear and be used indefinitely.
    2. The license you grant to SpeechForum is non-exclusive (meaning you are free to license your Content to anyone else in addition to SpeechForum), fully-paid and royalty-free (meaning that SpeechForum is not required to pay you or anyone else deriving rights from you for the use on The Speech Team, Inc. Services of the Content that you post), sublicensable (so that SpeechForum is able to use its affiliates, subcontractors and other partners such as Internet content delivery networks and wireless carriers to provide The Speech Team, Inc. Services), and worldwide (because the Internet and The Speech Team, Inc. Services are global in reach).
    3. You represent and warrant that: (i) you own the Content posted by you on, through or in connection with The Speech Team, Inc. Services, or otherwise have the right to grant the license set forth in this Section 6, and (ii) the posting of your Content on, through or in connection with The Speech Team, Inc. Services and/or Linked Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. You agree to pay for all royalties, fees, and any other monies owing any person or entity by reason of the use of any Content posted by you on or through The Speech Team, Inc. Services and/or Linked Services.
    4. The Speech Team, Inc. Services contain Content of SpeechForum ("SpeechForum Content"). SpeechForum Content is protected by copyright, trademark, patent, trade secret and other laws, and SpeechForum owns and retains all rights in the SpeechForum Content and The Speech Team, Inc. Services. SpeechForum hereby grants you a limited, revocable, nonsublicensable license to reproduce and display the SpeechForum Content (excluding any software code) solely for your personal use in connection with viewing the SpeechForum Website and using The Speech Team, Inc. Services.
    5. The Speech Team, Inc. Services contain Content of Users and other SpeechForum licensors. Except as provided within this Agreement, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, sell or otherwise use any Content appearing on or through The Speech Team, Inc. Services.
    6. SpeechForum performs technical functions necessary to offer The Speech Team, Inc. Services, including, but not limited to, the technical processing and transmission of email communications to perform the email service, and transcoding and/or reformatting Content to allow its use throughout The Speech Team, Inc. Services. In addition, you agree and acknowledge that SpeechForum may send messages including, but not limited to, notifications, special offers, promotions, commercial advertisements, and marketing materials, in connection with The Speech Team, Inc. Services. You can control what type of communications you receive from The Speech Team, Inc. Services by logging into your account and choosing the appropriate notifications settings or by following the unsubscribe instructions contained at the bottom of commercial emails.
    7. SpeechForum reserves the right to limit the storage capacity of Content that you post on, through or in connection with The Speech Team, Inc. Services.
  2. 7. Content Posted

Please choose carefully the information that you post on, through or in connection with The Speech Team, Inc. Services and that you provide to other Users. Your SpeechForum profile may not include any form of Prohibited Content, as outlined in Section 8 below. Despite this prohibition, information, materials, products or services provided by other SpeechForum Members (for instance, in their profiles) or Linked Services may, in whole or in part, be unauthorized, impermissible or otherwise violate this Agreement, and SpeechForum assumes no responsibility or liability for this material. If you become aware of misuse of The Speech Team, Inc. Services by any person or Linked Service, please click on the "Contact Us” link on the menu of The Speech Team, Inc. Website pages.

    1. SpeechForum may reject, refuse to post or delete any Content for any or no reason, including, but not limited to, Content that in the sole judgment of SpeechForum violates this Agreement or which may be offensive, illegal or violate the rights of any person or entity, or harm or threaten the safety of any person or entity. SpeechForum assumes no responsibility for monitoring the SpeechForum Services for inappropriate Content or conduct. If at any time SpeechForum chooses, in its sole discretion, to monitor The Speech Team, Inc. Services, SpeechForum nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content.
    2. You are solely responsible for the Content that you post on, through or in connection with any of The Speech Team, Inc. Services, and any material or information that you transmit to other Members and for your interactions with other Users.
  1. 8. Content/Activity Prohibited

The following are examples of the kind of Content that is illegal or prohibited to post on, through or in connection with The Speech Team, Inc. Services. SpeechForum reserves the right to investigate and take appropriate legal action against anyone who, in SpeechForum's sole discretion, violates this provision, including, without limitation, removing the offending Content from The Speech Team, Inc. Services, terminating the Membership of such violators and/or reporting such Content or activities to law enforcement authorities. Prohibited Content includes, but is not limited to, Content that, in the sole discretion of SpeechForum:

    1. is patently offensive or promotes or otherwise incites racism, bigotry, hatred or physical harm of any kind against any group or individual;
    2. harasses or advocates harassment of another person;
    3. exploits people in a sexual or violent manner;
    4. contains nudity, excessive violence, or offensive subject matter or contains a link to an adult website;
    5. solicits or is designed to solicit personal information from anyone under 18;
    6. publicly posts information that poses or creates a privacy or security risk to any person;
    7. constitutes or promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
    8. constitutes or promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files;
    9. involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";
    10. contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
    11. furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to, making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
    12. solicits or is designed to solicit passwords or personal identifying information for commercial or unlawful purposes from other Users;
    13. involves commercial activities and/or sales without prior written consent from SpeechForum such as contests, sweepstakes, barter, advertising, or pyramid schemes;
    14. includes a photograph or video of another person that you have posted without that person's consent;
    15. for band, comedy, filmmaker and other profiles, uses sexually suggestive imagery or any unfair, misleading or deceptive Content intended to draw traffic to the profile; or
    16. violates or attempts to violate the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other rights of any person.
    17. The following are examples of the kind of activity that is illegal or prohibited on the SpeechForum Website and through your use of The Speech Team, Inc. Services. SpeechForum reserves the right to investigate and take appropriate legal action against anyone who, in SpeechForum's sole discretion, violates this provision, including, without limitation, terminating your Membership and/or reporting such activity or Content to law enforcement authorities. Prohibited activity includes, but is not limited to:
    18. criminal or tortious activity, including, but not limited to, child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, defamation, stalking, spamming, spimming, sendingof viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;
    19. advertising to, or solicitation of, any Member to buy or sell any products or services through the unauthorized or impermissible use of The Speech Team, Inc. Services. You may not transmit any chain letters or junk email to other Members. In order to protect our Members from such advertising or solicitation, SpeechForum reserves the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which SpeechForum deems appropriate in its sole discretion. If you breach this Agreement and send or cause to send (directly or indirectly) unsolicited bulk messages, status or mood updates, bulletins or other unauthorized commercial communications of any kind through The Speech Team, Inc. Services, you acknowledge that you will have caused substantial harm to SpeechForum, but that the amount of such harm would be extremely difficult to ascertain. As a reasonable estimation of such harm, you agree to pay SpeechForum $50 for each actual or intended recipient of such unsolicited message, status or mood update, bulletin or other unauthorized commercial communication you send through The Speech Team, Inc. Services;
    20. circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person in circumventing or modifying any security technology or software that is part of The Speech Team, Inc. Services;
    21. activity that involves the use of viruses, bots, worms, or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of or access to a computer or a computer network;
    22. modifying, copying, distributing, downloading, scraping or transmitting in any form or by any means, in whole or in part, any Content from The Speech Team, Inc. Services other than your Content which you legally post on, through or in connection with The Speech Team, Inc. Services;
    23. providing or using “tracking” or monitoring functionality in connection with The Speech Team, Inc. Services, including, without limitation, to identify other Users’ views, actions or other activities on The Speech Team, Inc. Services;
    24. covering or obscuring the banner advertisements and/or safety features (e.g., report abuse button) on your personal profile page, or any SpeechForum page via HTML/CSS or any other means;
    25. any automated use of the system, such as, but not limited to, using scripts to add friends or send comments, messages, status or mood updates, blogs or bulletins;
    26. interfering with, disrupting, or creating an undue burden on The Speech Team, Inc. Services or the networks or services connected to The Speech Team, Inc. Services;
    27. impersonating or attempting to impersonate SpeechForum or a SpeechForum employee, administrator or moderator, another Member, or person or entity (including, without limitation, the use of email addresses associated with or of any of the foregoing);
    28. for band, comedy, filmmaker and other profiles containing a SpeechForum player, copying the code for your SpeechForum Player and embedding it (or directing others to embed it) anywhere other than in your band profile on SpeechForum;
    29. using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;
    30. selling or otherwise transferring your profile, your email address or URL;
    31. using or distributing any information obtained from The Speech Team, Inc. Services in order to harass, abuse, or harm another person or entity, or attempting to do the same;
    32. displaying an unauthorized commercial advertisement on your profile, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity through the unauthorized or impermissible use of The Speech Team, Inc. Services on behalf of that person, such as placing commercial content on your profile, links to e-commerce sites not authorized by SpeechForum, posting status or mood updates, blogs or bulletins with a commercial purpose, selecting a profile with a commercial purpose as one of your top friends, or sending messages with a commercial purpose;
    33. relaying email from a third party's mail servers without the permission of that third party;
    34. using invalid or forged headers to disguise the origin of any Content transmitted to or through SpeechForum’s computer systems, or otherwise misrepresenting yourself or the source of any message or Content;
    35. using any automated system, including, but not limited to, scripts or bots in order to harvest email addresses or other data from the SpeechForum Website for the purposes of sending unsolicited or unauthorized material;
    36. engaging in, either directly or indirectly, or encouraging others to engage in, click-throughs generated through any manner that could be reasonably interpreted as coercive, incentivized, misleading, malicious, or otherwise fraudulent; or
    37. using The Speech Team, Inc. Services in a manner inconsistent with any and all Applicable Law.
  1. 9. Protecting Copyrights and Other Intellectual Property

SpeechForum respects the intellectual property of others, and requires that our users do the same. You may not upload, embed, post, email, transmit or otherwise make available any material that infringes any copyright, patent, trademark, trade secret or other proprietary rights of any person or entity. It is SpeechForum’s policy to terminate, in appropriate circumstances, the membership of repeat infringers. If you believe your work has been copied and posted on or through The Speech Team, Inc. Services in a way that constitutes copyright infringement, please send SpeechForum's Copyright Agent a notification of claimed infringement with all of the following information: (a) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works; (b) identification of the claimed infringing material and information reasonably sufficient to permit us to locate the material on The Speech Team, Inc. Services (providing the URL(s) of the claimed infringing material satisfies this requirement); (c) information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address; (d) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (e) a statement by you, made under penalty of perjury, that the above information in your notification is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf; and (f) your physical or electronic signature.   1. 10. Third Party Linked Services

Linked Services created by third party developers may be available on, through or in connection with The Speech Team, Inc. Services. Linked Services include applications, websites, desktop, wireless, mobile and other services available from third parties which can be installed onto your SpeechForum profile or shared with other Users on The Speech Team, Inc. Services or which may link to your SpeechForum account from outside of The Speech Team, Inc. Services. Linked Services may use your SpeechForum profile information, friends and/or other profile content on the Linked Service and share activity events between SpeechForum and the Linked Service (depending on the features the Linked Service chooses to make available). When you engage with a third party Linked Service, you are interacting with the third party, not with SpeechForum. SpeechForum does not control the third party, and cannot dictate their actions. If you choose to use a third party Linked Service, the Linked Service may use and share your data in accordance with the privacy policy of and your privacy settings on such service. In addition, the third party providing the Linked Service may use other parties to provide portions of the application or service to you, such as technology, development or payment services. SpeechForum is not responsible for and makes no warranties, express or implied, as to the third party Linked Services or the providers of such Linked Services (including, but not limited to, the privacy practices thereof). SpeechForum encourages you not to provide any personally identifiable information to any third party Linked Service unless you know and are comfortable with the party with whom you are interacting.

 

  1. 11. Member Disputes

You are solely responsible for your interactions with other SpeechForum Users, third party developers or any other parties with whom you interact through The Speech Team, Inc. Services and/or Linked Services. SpeechForum reserves the right, but has no obligation, to become involved in any way with these disputes.

 

  1. 12. Privacy

This Privacy Policy describes SpeechForum’s use and sharing of personally identifiable information (“PII”-- your full name, email address, mailing address, telephone number, or credit card number) that Members voluntarily provide to SpeechForum when they register (also known as “Registration PII”). The Term “User” refers to a Visitor or a Member. This Privacy Policy applies to the services offered by SpeechForum, including any SpeechForum-branded URL (the “SpeechForum Website”), the SpeechForum instant messaging service, the SpeechForum application developer service and other features (for example, music and video embedded players), SpeechForum mobile services, and any other features, content, or applications offered from time to time by SpeechForum in connection with The Speech Team, Inc. Website (collectively, “The Speech Team, Inc. Services”). The Speech Team, Inc. Services are hosted in the United States.

 

The Speech Team, Inc. Website is a general audience site and does not knowingly collect PII from children under 13 years of age.

From time to time SpeechForum may modify this Privacy Policy to reflect industry initiatives or changes in the law, our PII collection and use practices, the features of The Speech Team, Inc. Services, or technology, and such modifications shall be effective upon posting by SpeechForum on The Speech Team, Inc. Website. Your continued use of The Speech Team, Inc. Services after SpeechForum posts a revised Privacy Policy signifies your acceptance of the revised Privacy Policy. It is therefore important that you review this Privacy Policy regularly to ensure you are updated as to any changes. If SpeechForum materially changes its practices regarding collection or use of your PII, your PII will continue to be governed by the Policy under which it was collected unless you have been provided notice of, and have not objected to, the change.

 

COLLECTION AND SUBMISSION OF PII AND NON-PII ON SPEECHFORUM

 

General. When SpeechForum collects PII from you it is because you are voluntarily submitting Registration PII to us in order to register as a Member of SpeechForum. SpeechForum may also collect PII from you if you choose to participate in The Speech Team, Inc. Services activities like sweepstakes, contests, and surveys, because you want us to furnish you with products, services, newsletters, or information, or in connection with content or suggestions you submit to SpeechForum for review.

 

In addition, SpeechForum collects other non-PII including IP address, aggregate user data, and browser type. This data is used to manage and improve The Speech Team, Inc. Services, track usage, and for security purposes.

 

SpeechForum Members may also choose to provide or store non-PII information in their profiles, including but not limited to date of birth, interests, hobbies, lifestyle choices, groups with whom they are affiliated (schools, companies), videos and/or pictures, private messages, bulletins or personal statements (collectively “Profile Information”). The Profile Information in a Member’s profile is provided at his or her sole discretion.

 

SpeechForum Members can change their Registration PII and Profile Information at any time and can control how Visitors, other Members and SpeechForum communicate with them by controlling their account settings, available within the “Edit Profile” portion of their SpeechForum profile.

Cookies. Cookies are small bits of information that SpeechForum places on your computer. SpeechForum uses cookies to identify your Internet browser, store Users’ preferences, and determine whether you have installed the enabling software needed to access certain material on The Speech Team, Inc. Services. Data in cookies may be read to authenticate user sessions or provide services.

 

Third party advertisements displayed on The Speech Team, Inc. Services may also contain cookies set by Internet advertising companies or advertisers (known as “third party cookies”). SpeechForum does not control these third party cookies and Users of The Speech Team, Inc. Services should check the privacy policy of the Internet advertising company or advertiser to see whether and how it uses cookies. See the “Notice” section below for more information on customized advertising on SpeechForum. A pixel tag is a tiny image inserted in a webpage and used to record the number and types of views for that page. SpeechForum may allow third party pixel tags to be present on The Speech Team, Inc. Services for purposes of advertising, providing services or data and statistics collection.

 

You can program your computer to warn you each time a cookie is being sent, block third party cookies or block all cookies. However, by blocking all cookies you may not have access to certain features on The Speech Team, Inc. Services.

 

NOTICE: SPEECHFORUM WILL PROVIDE YOU WITH NOTICE ABOUT ITS PII COLLECTION PRACTICES

 

When you voluntarily provide PII to SpeechForum, we will make sure you are informed about who is collecting the information, how and why the information is being collected and the types of uses SpeechForum will make of the information to the extent it is being used in a manner that differs from what is allowed pursuant to this Privacy Policy.

 

At the time you provide your PII, SpeechForum will notify you of your options regarding our use of your PII (See “Choice” below). Except as described in this Privacy Policy, SpeechForum will not share your PII with third parties unless you have given SpeechForum permission to do so (See “Use” below).

 

The Speech Team, Inc. Services may be linked to Internet sites operated by other companies. The Speech Team, Inc. Services may also carry advertisements from other companies. SpeechForum is not responsible for the privacy practices of websites or other services operated by third parties that are linked to or integrated with The Speech Team, Inc. Services or for the privacy practices of third party Internet advertising companies. Once you leave The Speech Team, Inc. Services via such a link, access a third party application (such as widgets) or click on an advertisement, you should check the applicable privacy policy of the third party or advertiser site to determine, among other things, how they will handle any PII they collect from you.

 

The Speech Team, Inc. Services may also be linked to sites operated by companies affiliated with SpeechForum (i.e., that are part of the News America Group: “Affiliated Companies”). Although all Affiliated Companies adhere to the News America corporate Privacy Principles, Users who visit those Affiliated Company sites should still refer to their separate privacy policies and practices, which may differ in some respects from this Privacy Policy.

 

SpeechForum may use cookies and similar tools to customize the content and advertising you receive based on the Profile Information you have provided. Profile Information you provide in structured profile fields or questions (multiple choice questions like “Marital Status,” “Education” and “Children”) (“Structured Profile Information”), information you add to open-ended profile fields and questions (essay questions like “About Me”) (“Non-Structured Profile Information”) and other non-PII about you may also be used to customize the online ads you encounter to those we believe are aligned with your interests. For example, based on your music interests we might display an advertisement to make sure you are advised when your favorite band is coming to town. Some of the advertisements that appear on The Speech Team, Inc. Services may also be delivered to you by third party Internet advertising companies. These companies utilize certain technologies to deliver advertisements and marketing messages and to collect non-PII about your visit to or use of The Speech Team, Inc. Services, including information about the ads they display, via a cookie placed on your computer that reads your IP address. Third party applications (such as widgets) created by third party developers may also be available on The Speech Team, Inc. Services. Third party applications are small bits of software, often with interactivity, that can be installed into Members’ profiles or shared with other Users. However, SpeechForum does not control the third party developers, and cannot dictate their actions. When a Member engages with a third party application, that Member is interacting with the third party developer, not with SpeechForum. SpeechForum encourages Members not to provide PII to the third party’s application unless the Member knows the party with whom it is interacting.

 

CHOICE: SPEECHFORUM WILL PROVIDE YOU WITH CHOICES ABOUT THE USE OF YOUR PII

 

Except as described in this Privacy Policy, SpeechForum will get your permission before we use the PII you provide to us in a way that is inconsistent with the purpose for which it was submitted or share your PII with third parties that are not affiliated with SpeechForum.

 

USE: SPEECHFORUM'S USE OF PII

 

SpeechForum will only use the PII you provide under this Privacy Policy in a manner that is consistent with this Privacy Policy. If SpeechForum obtains PII from a third party, such as a business partner, our use of that information is also governed by this Privacy Policy.

 

In order to locate other SpeechForum Members that you may already know in the physical world, SpeechForum allows Users to search for Members using Registration PII (i.e., full name or email address). SpeechForum also allows Users to browse for certain Profile Information in order to help connect with Members (i.e., schools and/or companies where Users may have attended or worked). SpeechForum may also enable Members to publicly display some Registration PII as an element of their Profile Information if they choose to do so via a profile setting under “Edit Profile.” Search engines may index the portion of a Member’s profile (including the Profile Information it contains) that is publicly displayed.

 

If you have consented to receive promotional materials (e.g., newsletters) or notifications from SpeechForum, SpeechForum may periodically use your email address to send you such materials related to The Speech Team, Inc. Services, as applicable. If you want to stop receiving such materials from SpeechForum, you can change your profile settings under “Account Settings,” or follow the unsubscribe instructions at the bottom of each email.

 

SpeechForum employees, agents and contractors must have a business reason to obtain access to your PII. SpeechForum may share your PII with those who help us manage or provide The Speech Team, Inc. Services’ information activities (for example, message board administration, order fulfillment, statistical analyses, data processing), or with outside contractors, agents or sponsors who help us with the administration, judging and prize fulfillment aspects of contests, promotions and sweepstakes.

 

These outside contractors, agents or sponsors may temporarily store some information on their servers, but they may only use your PII to provide SpeechForum with a specific service and not for any other purpose. SpeechForum may also provide your PII to a third party in those instances where you have chosen to receive certain information and have been notified that the fulfillment of such a request requires the sharing of your PII. SpeechForum also may share your PII with Affiliated Companies if it has a business reason to do so.

 

As described in “Notice” above, SpeechForum may customize the advertising and marketing messages you receive on the The Speech Team, Inc. Website, or may work with outside companies to do so. Your non-PII and/or Profile Information may be shared with these companies so this customization can be accomplished. SpeechForum prohibits these companies from sharing your non-PII and/or Profile Information with any third party or from using it for any other purpose. Anonymous click stream, number of page views calculated by pixel tags, and aggregated demographic information may also be shared with SpeechForum’s advertisers and business partners.

 

There may be instances when SpeechForum may access or disclose PII, Profile Information or non-PII without providing you a choice in order to: (i) protect or defend the legal rights or property of SpeechForum, our Affiliated Companies or their employees, agents and contractors (including enforcement of our agreements); (ii) protect the safety and security of Users of The Speech Team, Inc. Services or members of the public including acting in urgent circumstances; (iii) protect against fraud or for risk management purposes; or (iv) comply with the law or legal process. In addition, if SpeechForum sells all or part of its business or makes a sale or transfer of all or a material part of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, SpeechForum may transfer your PII to the party or parties involved in the transaction as part of that transaction.

 

When a Member who is located in the European Union chooses to post Profile Information that will be publicly disclosed, that Member is responsible for ensuring that such information conforms to all local data protection laws. SpeechForum is not responsible under the EU local data protection laws for Member-posted information.

 

SECURITY: SPEECHFORUM PROTECTS THE SECURITY OF PII

 

SpeechForum uses commercially reasonable administrative, technical, personnel and physical measures to safeguard PII and credit card information in its possession against loss, theft and unauthorized use, disclosure or modification. In addition, SpeechForum uses reasonable methods to make sure that PII is accurate, up-to-date and appropriately complete.

 

ACCESS, REMEDIES AND COMPLIANCE: HOW TO ACCESS, CORRECT OR CHANGE YOUR PREFERENCES REGARDING YOUR PII AND HOW TO CONTACT SPEECHFORUM ABOUT PRIVACY CONCERNS

 

Whenever possible, SpeechForum Members may review the Registration PII we maintain about them in our records. We will take reasonable steps to correct any PII a Member informs us is incorrect. If you are a Member, you can view and change your Registration PII, Member preferences and Profile Information by logging into your account and accessing features such as “Edit Profile” and “Account Settings.”

 

If you ask SpeechForum to stop using your PII, SpeechForum will honor that request while retaining any record of your PII that is necessary to comply with applicable federal, state or local law.

IN NO EVENT SHALL SPEECHFORUM BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SPEECH TEAM, INC. SERVICES OR LINKED SERVICES, EVEN IF SPEECHFORUM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, SPEECHFORUM'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO SPEECHFORUM FOR THE SPEECH TEAM, INC. SERVICES DURING THE TERM OF MEMBERSHIP.

 

  1. 15. U.S. Export Controls

Software available in connection with The Speech Team, Inc. Services (the "Software") is further subject to United States export controls. No Software may be downloaded from The Speech Team, Inc. Services or otherwise exported or re-exported in violation of U.S. export laws. Downloading or using the Software is at your sole risk.

 

  1. 16. Disputes

The Agreement shall be governed by, and construed in accordance with, the laws of the State of New York, without regard to its conflict of law provisions. You and SpeechForum agree to submit to the exclusive jurisdiction of the courts located within the State of New York to resolve any dispute arising out of the Agreement or The Speech Team, Inc. Services. EACH OF THE PARTIES HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION (INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS, COUNTERCLAIMS, CROSS-CLAIMS, OR THIRD PARTY CLAIMS) ARISING OUT OF, UNDER OR IN CONNECTION WITH THIS AGREEMENT. FURTHER, EACH PARTY HERETO CERTIFIES THAT NO REPRESENTATIVE OR AGENT OF EITHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH PARTY WOULD NOT IN THE EVENT OF SUCH LITIGATION, SEEK TO ENFORCE THIS WAIVER OF RIGHT TO JURY TRIAL PROVISION. EACH OF THE PARTIES ACKNOWLEDGES THAT THIS SECTION IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY ENTERING INTO THIS AGREEMENT.

 

  1. 17. Indemnity

You agree to indemnify and hold SpeechForum, its subsidiaries, and affiliates, subcontractors and other partners, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including, but not limited to, reasonable attorneys' fees, made by any third party due to or arising out of your use of The Speech Team, Inc. Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth in this Agreement and/or any Content that you post on, through or in connection with The Speech Team, Inc. Services.

 

  1. 18. Other

This Agreement is accepted upon your use of The Speech Team, Inc. Website or any of the The Speech Team, Inc. Services and is further affirmed by you becoming a Member. Your agreement with SpeechForum will always include this Agreement at a minimum. Your access and use of certain The Speech Team, Inc. Services will require you to accept additional terms and conditions applicable to such certain The Speech Team, Inc. Services, in addition to this Agreement, and may require you to download Software or Content. The failure of SpeechForum to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. SpeechForum is a trademark of The Speech Team, Inc. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
